Except as otherwise and expressly provided for in other specific provisions, the terms listed below have in these General Conditions of Sale, the meaning that is attributed to them in the following definitions: “Business Day” or “Business Days” means the days on which the our offices are open for normal activities (generally every day from 9 to 18 excluding Saturdays, Sundays, holidays and on occasion of some exceptional circumstances of which we will promptly inform you on this site) “Force Majeure Events” include situations resulting (directly or indirectly) from any strikes, lockouts, fires, floods, proven inability to obtain products, materials or services, failures, delays from suppliers or couriers, government laws or regulations or any other cause or event that out of our control.
The above is provided as an example only.
There are other events that may have a force majeure character.
By sending the order online, the Customer sends M FASHION SRL a proposal to purchase the product and / or products included in the cart. When the Customer places an online order for the products he has placed in the cart, he agrees to purchase them at the price and terms indicated in these General Conditions of Sale.
M FASHION SRL will send the Customer an e-mail of acceptance and confirmation of the order containing the number, date and total amount of the order as well as the methods of delivery of the product.
If, for any reason, M FASHION SRL is unable to accept the Customer’s order (for one of the cases indicated below), it will immediately communicate it to the Customer via the website itself.
In particular M FASHION SRL will not accept orders:
- if the material is not available in the warehouse at the time of the order (if the material is not available, it will not be possible to add it to the cart) and / or – if the Customer’s credit card issuer does not confirm the payment.
M FASHION SRL however reserves the right not to accept the order, at its discretion.
These General Conditions of Sale must be examined online by Customers before submitting their orders. The submission of the order therefore implies their total knowledge and their full acceptance.
The Customer undertakes and undertakes, once the online purchase procedure is concluded, to print and keep these general conditions of sale, already viewed and accepted during the purchase process carried out, in order to fully satisfy the condition of which to the articles 3 and 4 of Legislative Decree no. 185/1999.
All prices on the site are VAT included.
The prices shown on this site are the sales prices currently in force. In the event that the price of the goods ordered is reported by M FASHION SRL in a clearly discordant manner, the order may be canceled at any time by M FASHION SRL or by the Customer, provided that before sending the goods, it will be possible to reorder products at the correct selling price.
The payment of the purchased products and the related shipping costs must be made by the customer when placing the order by using one of the credit cards available and indicated online or by bank transfer. In this case M FASHION SRL will process the order upon receipt of the bank transfer.
M FASHION SRL is not responsible for any fraudulent and illegal use that may be made by third parties of credit cards when paying for the products purchased.
In case of acceptance of the order it is specified that:
– if the order was made on a non-working day, the goods will in any case be shipped on the first following Business Day.
Exceptions may occur in the event of Force Majeure Events.
The goods will be delivered through a home courier service. Shipping means delivery of the goods to the courier. The delivery times described during the purchase process on the site depend on the shipping method used, depending on the weight and size of the items purchased. The courier will deliver the goods only against a signature confirming receipt of the same.
In the event that the goods, sent by courier, do not arrive within the established deadline, the Customer must contact M FASHION SRL at the addresses indicated on this site.
In the event that the goods have not been delivered due to the Customer’s inability to receive them, the latter must first contact the courier through the references that are left by the courier for cases of non-receipt of the goods.
LIABILITY FOR DELAYED DELIVERY
If the shipment of the goods does not take place within the agreed times or the courier in charge does not deliver the goods within the expected delivery times, M FASHION SRL will contact the customer as soon as possible and, based on the needs of the latter, will seek to set another delivery time.
If delivery in short times is essential, the Customer is advised to purchase well in advance, or to contact M FASHION SRL before the order to agree on the possibility of delivery with the Customer’s needs.
Pursuant to art. 5 DL 185/1999, if the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his business or professional activity), he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.
To exercise this right, the customer must contact and send M FASHION SRL a notice of withdrawal within 10 days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt, addressed to

by telegram or fax always sent within the aforementioned 10-day period and followed by a confirmation sent by registered letter with acknowledgment of receipt within the following 48 hours.
Once the aforementioned notice of withdrawal has been received, M FASHION SRL will promptly communicate to the customer the details on how to return the goods.
It is the Customer’s responsibility, if the error did not depend on a fact attributable to M FASHION SRL, to fully bear the costs of returning the goods.
The goods must be returned intact and in the original packaging, complete with all its parts and without having been damaged in any way. Upon arrival in the warehouse, the goods will be examined and, in the presence of damage or tampering, the withdrawal cannot be exercised. M FASHION SRL will refund the customer the full amount already paid within the terms of the law.
The refund will be made by crediting the amount due by bank transfer for the refunded purchase. It will be the customer’s responsibility to promptly provide M FASHION SRL with any information necessary for a correct and prompt refund procedure.
Any complaints must be addressed directly to M FASHION SRL, after contacting the telephone numbers or e-mail address indicated on the site.
